Statute
These regulations ("Regulations") define the rules and conditions for the sale of goods in the online store located at: www.bluejeanbeauty.eu ("Online Store").
I. PRELIMINARY PROVISIONS
- The owner of the Online Store is: Blue Cosmetics with its registered office: ul. Szewska 2, 61-760 Poznań, NIP: 7712765783, e-mail: info@bluejeanbeauty.eu ("Blue Cosmetics").
- To use the Online Store, including browsing the Goods available in the Online Store's assortment and placing orders, you need: a) a computer, telephone, tablet or other device with access to the Internet; b) web browser: Safari, Chrome, Internet Explorer, Firefox or Opera; c) active e-mail account.
- Customers of the Online Store may be adult natural persons with at least limited legal capacity and legal persons or organizational units without legal personality, having legal capacity and capacity to perform legal acts.
II. DEFINITIONS
- Customer – any person who uses the Online Store in any way.
- Basket - an element of the Online Store in which the Customer specifies the details of the order, such as: Customer data, quantity of Goods, delivery address, invoice data, method of delivery, form of payment and other data whose disclosure is necessary in connection with the execution of the order.
- Newsletter - commercial information regarding Blue Cosmetics, in particular regarding Goods, new products, promotions, etc.
- Online Store - IT platform managed by Blue Cosmetics, operating at: www.bluejeanbeauty.eu
- Goods – products for which you can place an order in the Online Store.
III. RULES FOR PLACING ORDERS
- Before placing an order in the Online Store, the Customer should read these Regulations.
- Information about the Goods available in the Online Store's assortment does not constitute an offer within the meaning of the Civil Code. Information about the Goods provided on the Online Store website constitutes an invitation to submit offers by Customers.
- By placing an order in the Online Store, the Customer submits to Blue Cosmetics an offer to conclude a sales (purchase) contract for the selected Goods. The conclusion of a sales contract requires placing an order by the Customer and then confirming to the Customer that the order has been accepted for processing by Blue Cosmetics, after Blue Cosmetics has verified the availability of the Goods in the warehouse.
- Placing orders in the Online Store is possible 7 days a week, 24 hours a day.
- The Customer may place an order in the Online Store by selecting the Goods presented on the Online Store website and adding them to the Cart.
- After adding the Goods to the Cart and providing the data necessary to complete the order, the Customer confirms placing the order by clicking the button: "ORDER AND PAY".
- The prices of the Goods available in the Online Store at the time the Customer places the order are binding for the Customer and Blue Cosmetics. The prices of the Goods available in the Online Store are given in Polish zloty and include VAT (gross prices).
- The price of the Goods given on the Online Store website does not include the cost of shipping the Goods to the Customer. The price of the Goods includes the shipping cost, the amount of which is indicated in the Basket, before the Customer confirms the order. Shipping costs depend on the method of delivering the Goods to the Customer, the value and size of the order.
- The entity providing online payment services is Blue Media SA
- A customer placing an order in the Online Store may use the following payment methods: a) payment "cash on delivery" - in cash upon receipt of the ordered Goods, if the delivery method is selected via a courier company, after delivery of the Goods to the Customer; b) payment by transfer - before collecting the ordered Goods, to the Blue Cosmetics bank account indicated on the Online Store website: www.bluejeanbeauty.eu ; c) BLIK payment; d) online payment via quick transfers or by payment card, via the payment website of the Blue Media operator.
IV. ORDER FULFILLMENT
- Blue Cosmetics confirms to the Customer that the order has been accepted for processing to the e-mail address provided by the Customer when placing the order, within 3 business days or, in the case of promotional campaigns, up to 7 business days from the date of placing the order.
- If the execution of the order placed by the Customer is not possible due to the lack of availability of the Goods in the warehouse (e.g. due to the simultaneous placing of an order for the same Goods by many customers), Blue Cosmetics informs the Customer about this fact within the deadline specified in section 1 above, by sending a message to the e-mail address provided by the Customer. If some of the Goods included in the order are unavailable, the Customer decides whether the order is to be completed partially or canceled in full.
- The Customer may change or cancel the order via the e-mail address: info@bluejeanbeauty.eu , until Blue Cosmetics sends the ordered Goods.
- In the event of cancellation of the order in the situation indicated in section 2 or section 3 above, if the payment was made in advance, Blue Cosmetics will refund the Customer the amount paid (or part of it in the case of partial execution of the order) within five business days from the date of cancellation of the order.
- Goods ordered in the Online Store are delivered to the delivery address indicated by the Customer when placing the order in the Republic of Poland within three business days or, in the case of promotional campaigns, up to seven business days from the date of sending the confirmation of acceptance of the order to the Customer.
- If the Customer chooses a payment method other than "cash on delivery", the condition for accepting the order for processing is prior payment for the ordered Goods. If the Customer chooses the payment method by transfer, Blue Cosmetics will accept the order for processing after the payment for the ordered Goods has been credited to the Blue Cosmetics bank account. If the Customer chooses the payment method by transfer, the Customer should make the payment within three days from the date of placing the order.
- The shipment is delivered to the Customer via a courier company (DPD or InPost) or via InPost parcel lockers to the parcel locker selected by the Customer. Delivery of the parcel to the Customer or to the parcel locker selected by the Customer will be made on a business day.
- An attempt is made to deliver the parcel to the customer only once. If the Customer was absent at the indicated address, he should contact the courier company and arrange re-delivery. After the second unsuccessful delivery attempt, the Goods will be returned to the Blue Cosmetics warehouse and the order will be canceled. In such a situation, Blue Cosmetics will refund the amount paid to the Customer within five business days from the date of return of the Goods to the Blue Cosmetics warehouse.
- The customer should check the condition of the shipment upon receipt in the presence of the courier. If the shipment is damaged, the Customer should prepare a damage report in the presence of the courier and immediately contact the Online Store.
V. WITHDRAWAL FROM THE CONTRACT AND RETURNS
- Pursuant to the Act on Consumer Rights of May 30, 2014, a Customer who is a consumer who has concluded a distance contract may withdraw from the Goods sales contract without giving a reason within 14 days from the date of taking possession of the Goods by the Customer or a person indicated by him. third party other than the carrier. In the case of a contract that covers many Goods that are delivered separately, in batches or in parts, the deadline for withdrawal from the contract is counted from taking possession of the last Goods, batch or part.
- To exercise the right to withdraw from the contract, the Customer must inform Blue Cosmetics of his decision to withdraw from the contract by means of an unambiguous statement sent to the following address: info@bluejeanbeauty.eu . The customer may use the contract withdrawal form available on the Online Store website, but this is not obligatory.
- In the event of withdrawal from the contract, the Customer is obliged to return the Goods no later than 14 days from the date on which he informed Blue Cosmetics about withdrawal from the contract. To meet the deadline, it is enough to return the Goods before its expiry. The goods should be returned in undeteriorated condition, in the original packaging, if possible.
- Blue Cosmetics will refund all payments made by the Customer, including the costs of delivering the Goods to the Customer (except for additional costs resulting from the Customer's chosen delivery method other than the cheapest regular delivery method offered by Blue Cosmetics) immediately and in any case no later than 14 days from the date on which Blue Cosmetics was informed about the Customer's decision to exercise the right to withdraw from the contract. Blue Cosmetics refunds the payment using the same payment methods that were used by the Customer in the original transaction, unless the Customer has expressly agreed to a different solution; in any case, the Customer will not incur any fees in connection with this return.
- The Customer bears the direct costs of returning the Goods to Blue Cosmetics.
- The Customer is not entitled to withdraw from a distance contract in relation to a contract: a) in which the subject of the service is a non-prefabricated item, manufactured according to the Customer's specifications or serving to meet his individual needs; b) in which the subject of the service is an item that deteriorates quickly or has a short shelf life; c) in which the subject of the service is an item delivered in a sealed package, which cannot be returned after opening the package due to health protection or hygiene reasons, if the package was opened after delivery; d) in which the subject of the service are items which, after delivery, due to their nature, are inseparably connected with other items; e) in which the subject of the service are sound or visual recordings or computer programs delivered in a sealed package, if the package was opened after delivery.
VI. COMPLAINTS AND WARRANTIES
- Blue Cosmetics is obliged to deliver the Goods to the Customer without physical and legal defects. Blue Cosmetics is liable for defects in the Goods under the terms set out in the provisions of the Civil Code, in particular in Art. 556 and 556^1 - 556^3 CC.
- If physical defects of the Goods are found, the Customer has the right to submit a complaint within two years from the date of delivery of the Goods. If the defect was discovered within one year from the date of delivery of the Goods, it is presumed that the defect existed at the time of transfer of risk to the Customer.
- Complaints may be submitted: a) in writing to the following address: Blue Cosmetics, ul. Szewska 2, 61-760 Poznań; b) electronically to the following address: info@bluejeanbeauty.eu .
- The complaint should include the Customer's data, a description of the defect of the Goods and the Customer's request in connection with the submitted complaint.
- Blue Cosmetics considers the complaint within 14 days from the date of its receipt and informs the Customer about its consideration to the e-mail address provided by the Customer when submitting the complaint. If the complaint is upheld, Blue Cosmetics will repair the Goods or replace the defective Goods with a new one, free from defects. If repair or replacement of the Goods is not possible or requires excessive costs, the Customer has the right to demand an appropriate price reduction or withdrawal from the contract and refund of the price paid for the Goods.
- In the case of a contract concluded with a Customer who is not a consumer, Blue Cosmetics' liability under the warranty is excluded.
VII. PERSONAL DATA PROTECTION
- The administrator of personal data of Online Store Customers is Blue Cosmetics.
- Customers' personal data are processed by Blue Cosmetics in accordance with applicable law, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement such data and repealing Directive 95/46/EC ("GDPR").
- Providing personal data by the Customer is voluntary, but necessary to complete the order.
- The customer has the right to access their personal data and correct it, delete it, limit processing, transfer data, as well as the right to object to the processing of personal data.
- The customer has the right to lodge a complaint with the supervisory authority, which is the President of the Personal Data Protection Office.
- Customers' personal data are processed by Blue Cosmetics in order to: a) fulfill orders; b) handling the registration process and logging in to the Customer's account; c) sending the Newsletter (with the Customer's consent); d) direct marketing of Blue Cosmetics products and services.
- Customers' personal data are not transferred to other entities, except for entities authorized under the law, as well as entities cooperating with Blue Cosmetics to the extent necessary to process orders (courier companies, payment operators).
VIII. FINAL PROVISIONS
- Blue Cosmetics reserves the right to make changes to the Regulations for important reasons, in particular changes in applicable law, changes in payment and delivery methods, to the extent that these changes affect the implementation of the provisions of these Regulations.
- In matters not regulated in these Regulations, the provisions of Polish law shall apply, in particular the Civil Code and the Act on Consumer Rights of May 30, 2014.
- Changes to the Regulations are effective from the moment they are published on the Online Store website. Changes to the Regulations do not affect the rights acquired by Customers using the Online Store before the amendment to the Regulations.
- The Regulations enter into force on May 18, 2024.
